How to open a business in the United States

AmCham PeruInfo provided and translated by the
American Chamber of Commerce of Peru (AmCham Peru)

For many people there is no greater dream than opening a business in the United States and without a doubt, this desire has increased with the upcoming approval of the Peru – United States TPA, that has arisen greater interest for opening up new businesses in the American territory.

Evidently, a business' success, in United States as well as in any other place in the world, depends on being in the right place at the right time, and this demands a previous and mandatory step: the conduction of a market research study that confirms “what is needed and where it is needed”.

So, in order to decide what kind of business you want to start, it is necessary to analyze the comparative advantages that you have in a determined sector, and once you have chosen what field you want to work in, develop a business plan that reflects your commercial objectives and the way to achieve them. The business plan is nothing else than an operational map and includes things such as: the ownership, the marketing strategy, the description of the products or services to be provided, the financial documents of the actives and passives, the cash flow, between others. It is necessary to consider that a good business plan gives specific and organized information about the company and works as a road map that helps building the path to success. Without it, it is very difficult for a company to achieve its goals.

Besides, it must be considered that every business in United States has to comply with legal licenses, insurances and registrations. Before starting with the paper work a businessman needs to determine the kind of company he wants. If the company has only one owner, the legal requirements are easier, although the owner takes almost unlimited responsibility and resign to some tax incentives. On the contrary, if the company has two or more partners, it is recommended to have a written agreement. According to the Small Business Administration (SBA), the written agreement should define at least: the type of businesses, the amount of Money provided by each partner, the benefits division, the distribution of assets in case of dissolution, the duration of the association, the dispute settlement mechanism, between others.

Then, this article aims to share with its readers some fundamental consideration for opening a business in the U.S., however, the subject can be discussed in extension in order to analyze subjects as taxes, brand registration and authors rights and other regulations that might influence your commercial objectives as well as the decision of establishing a business in United States.

This is a very interesting article about the possibility to start a business in the US.  However, it would be more beneficial to obtain more details about how to start up a business in the US and a list of possible entities that encourage and support such foreign investment in the US.  Food for thought!

My father always said the best way to obtain a milion dollars in the US was to invest 2 million in a business.   At the end of the year you MIGHT  have a million left after taxes and fees.   YOU WILL ALSO NEED A LOBBY TO HANDLE THE POLITICIANS.
