Two Peruvian women that immigrated to the US to work as maids, and who were forced to sleep in a closet and to work 19 hours a day, will receive US $125,000 dollars as a legal compensation on damage and unpaid salaries. # alfredo says :

What the note don't tell is that the Hoyles are peruvians also. Javier Hoyle is Regional Manager of IBM del Perú.
The practice of retaining passports and deportation threats are quite common. Now the peruvian upper class will have to think twice before they continue to treat their "cholas" as they do it in Perú when they carry them to work in USA. Now they know best.

In the USA, women are coached by many woman only government and not-for-profit organizations to criminalize men.
In the USA abuse is broadly defined to include just about anything and proof is not required. The woman is always a victim of a man, and the man always is guilty with only an accusation.

Gary, this is the interpretation:
It's common to hear this complaint among upper class ladies: "Ay, hija, ahora uno tiene que ser chola de las cholas, te imaginas?..."(Nowadays we have to be chola de las cholas").
They are referring to the fact that now the maids a.k.a. "empleadas" are requesting several benefits and rights that they before didn't. The employer must provide decent and sanitary lodging, respect the eight hours, good food, meal breaks, minimum wage, overtime, etc., etc.,etc. In a word, to their horror, the previous almighty masters must be sure that their maids are happy and comfortable.

Unfortunately, this example is only the tip of the iceberg.
Such type of exploitation is widely spread.
As far as I can see, the defendant still has the opportunity to lodge an appeal. And the case will be pending, making it unlikely that the compensation will be paid to the maids already at the current stage.
Hence, what will Mr. Clean „Hoyle (an IBM's top executive)“ do?
And what can 2 maids do?
Sadly, money wins the game, in particular in the U.S.A.
And „Otorongo no come Otorongo“, as it is said in Peru.

I'm sure there are many other cases like the ones mentioned but unfortunately they used the wrong people to use as examples. Passports are held by the employer because the US visa issued stipulates that that the nannies cannot travel without the employer, nor can the work for another employer. One nanny was hired to replace the other who ran away and found employment elsewhere as an illegal immigrant. At that point the first nanny and the attorney have been working on building a case based on a lot of false and fabricated information. It would have been nice to set a precedence using a real example but it isn't the case. These nannies really had it made in Key Biscayne and out of greed did this. But you know what they say....KARMA is a bitch.

Fortunately no one country has the franchise on mistreatment of foreign workers. In any country where there are expat's working, there you will find someone being abused, certainly not all of them, but some.
The evil is in individuals. Carlos has never did anything wrong?

El Cid, I witnessed the case first hand and I can tell you that I was in favor of the nannies 100%. What I can also say is that Javier Hoyle is being portrayed very negatively in the media. As much as I don't agree in the small living space the nannies were given to sleep, and the lack of respect they were given, I think that Javier Hoyle and Patricia Perales' biggest fault was that they were cheap. Had they paid these ladies on time and for the hours worked then this lawsuit would have never happened. Hispanic people who have servants in their countries are accustomed to the live-in nannies being "on call" 24/7, I'm glad that Onelia Maco-Castro realized that she had rights in the U.S. and that she was being over-worked. I don't believe that Hoyle is a bad guy, just a cheap one. His wife on the other hand needs a lesson in how to treat household employees. She was the one in charge while Hoyle was at work. He is definitely not the only one to blame. I hope the nannies receive the full $125,000 because they earned it.Add your comment
