Yale Files Motion To Dismiss Peru's Lawsuit

When Peru filed a lawsuit in U.S. District Court in Washington D.C. demanding that Yale University return a collection of Incan artifacts, it chose the wrong venue, according to a motion filed this month by the university.

In its motion to dismiss Peru's lawsuit, Yale says the District of Columbia has nothing to do with the dispute. None of the allegations against Yale took place there and the disputed property has been in Connecticut for more than 90 years.

"If Peru wishes to pursue its stale and meritless claims, it must do so in Connecticut," the legal document states.

The dispute centers on relics taken from Machu Picchu and surrounding areas by a Hiram Bingham III, a Yale scholar, nearly 100 years ago.

The Republic of Peru filed a lawsuit Dec. 5 saying the Bingham dug up mummies, human bones, pottery, utensils and art and brought them to the university under conditions set by the Peruvian government that the items would be returned. Some, but not all of the items, were returned.

"The most valuable and archaeologically significant artifacts ... were never returned to Peru and remain in the custody of Yale," the lawsuit states.

Since they would have had to hire lawyers barred in the US, I can't believe the lawyers were that stupid.

Unless Peru never intended to win - just to make a political/social statement.

Peruvian lawyers were not stupid. There is precious little justice in the U.S. Justice system, and Yale's lawyers are slick and slippery. Keep at it Peru!

There's nothing slick or slippery about it.  The lawyers (and I don't know if they were necessarily Peruvian), filed the lawsuit in the wrong jurisdiction.

Now, that really gets me going! What's meritless about Peru trying to recover its cultural heritage? Granted, 100 years ago, some gringo casually discovered some ruins, in "someone else's country!" and the Peruvian government of 100 years ago made a sort of deal. Too bad!
This relics still belong to someone else and that is not Yale.
Sure, the lawyers messed up. But this is only the first round... a whole media storm should be unleash. Yale cares more about its image and publicity than its actual students themselves, so, let's hit them where it hurts Peru!
